1. Information That We Collect From You

When you visit the Website or make a Yordar order through the Website, you may be asked to provide information about yourself including your name, address(es), telephone number(s), electronic address(es) and other contact details and payment information such as credit or debit card information. We may also collect transaction details relating to your use of our products, services or benefits, and information about your usage of the Website and information about you from the messages you post to the Website and the e-mails or letters you send to us. 

We will not collect sensitive information from you or any third party.

From time to time, you may provide us, and we may collect from you, personal information of a third party (for example, for delivery purposes). Where you provide the personal information of a third party, it is your responsibility to ensure that those persons are aware of this Privacy Policy, understand it and agree to accept it.

You do not have to provide us with any personal information, however if you do not do so we may not be able to provide you with the products, services or benefits you have requested.

2. Use Of Your Information

Your personal information will enable us to provide you with access to the relevant parts of the Website and to supply the services you have requested. It will also enable us to bill you and to contact you where necessary concerning our services. We will also use and analyse the personal information we collect so that we can administer, support, improve and develop our business, for any other purpose whether statistical or analytical and to help us prevent fraud. 

We will use the personal information we collect for the purpose disclosed at the time of collection, or otherwise as set out in this privacy policy. We will not use your personal information for any other purpose without first seeking your consent, or where authorised or required by law.

We may use your personal information to contact you for your views on our services and to notify you occasionally about important changes or developments to the Website or our services.

You agree that we may use your personal information to let you know about our other products and services that may be of interest to you including services that may be the subject of direct marketing and we may contact you to do so by post, telephone, mobile messaging (e.g. SMS, MMS etc.) as well as by e-mail. 

If you do not want us to use your data in this way or change your mind about being contacted in the future, please let us know by using the contact details set out below, amending your profile accordingly, and/or via the unsubscribe function made available to you with each direct marketing communication.

Please note that by submitting comments and feedback regarding the Website and the services, you consent to us to use such comments and feedback on the Website and in any marketing or advertising materials. We will only identify you for this purpose by your first name and the city in which you reside.

3. Disclosure Of Your Information

Third parties process personal information such as credit card payments and provide support services related to payments for us. Third parties also help us analyse the information we collect so that we can administer, support, improve and develop our business and services to you. In addition, we may need to provide your information to any suppliers, caterers or restaurants ("Partner Providers") that you have placed your order with. By submitting your personal information, you agree to this transfer, storing or processing. Yordar will take all steps reasonably necessary to ensure that your data is treated securely and in accordance with this privacy policy.

You agree that we may allow carefully selected third parties, including marketing and advertising companies, our affiliates and associates, to send direct marketing to you occasionally about services that may be of interest to you. They may contact you by telephone, SMS as well as by e-mail. If you change your mind about being contacted by these companies in the future you may opt-out of receiving this information through the unsubscribe function that will be made available to you with each direct marketing communication.

If our business enters into a joint venture with, purchases or is sold to or merged with another business entity, your personal information may be disclosed or transferred to the target company, our new business partners or owners or their advisors.

We may use the personal information that you provide to us if we are under a duty to disclose or share your personal information in order to comply with (and/or where we believe we are under a duty to comply with) any legal obligation; or in order to enforce our Website Terms and any other agreement; or to protect the rights of Yordar, Partner Providers or others. This includes exchanging information with other companies and other organisations for the purposes of fraud protection and prevention.

4. Security And Data Retention

We take steps to protect your personal information from unauthorised access and against unlawful processing, accidental loss, destruction and damage. We will keep your personal information for a reasonable period or as long as the law requires.

Additionally, we take reasonable steps to destroy or permanently de-identify personal information when we no longer need it.

Where you have chosen a password which allows you to access certain parts of the Website, you are responsible for keeping this password confidential. We advise you not to share your password with anyone.

Unfortunately, the transmission of information via the internet is not completely secure. Although we will take steps to protect your personal information, we cannot guarantee the security of your data transmitted to the Website and do not accept responsibility for the security of information you send to or receive from us over the internet, or for any unauthorised access or use of that information. Any transmission is at your own risk. Once we have received your information, we will use strict procedures and security features to try to prevent unauthorised access.

5. Accessing And Updating

We will take reasonable steps to make sure that the personal information we collect, use or disclose is accurate, complete and up to date. If your personal details change, such as your address or phone number, please let us know by using the contact details set out below or by amending your profile accordingly.

You have the right to see the personal information we hold about you ("Access Request") and to ask us to make any changes to ensure that it is accurate and up to date, unless an exception under the Privacy Act 1988 (Cth) applies. If you wish to do this, please contact us using the contact details set out below. In the event that you make an Access Request, we may charge a fee for retrieving this information, in which case we will inform you of the fee and obtain your agreement to that fee before providing the information.

We will promptly acknowledge and investigate any complaint about the way we manage personal information.

6. Cookies

Our Website uses cookies to track user traffic patterns and to better serve you when you revisit our Website. A cookie is a small data file that a website may write to your hard drive when you visit it. A cookie file can contain information, such as a user ID which the website uses to track the pages you have visited. You can refuse all cookies by turning them off in your browser. However, full functionality for our Websites requires the use of cookies.

Information is also generated whenever a page is accessed on our Website that records information such as the time, date and specific page. We collect such information for statistical and maintenance purposes that enables us to continually evaluate our Website performance.

Any changes to our Privacy Policy will be posted to the Website and, where appropriate, through e-mail notification.

TERMS & CONDITIONS

Confirmation of your booking

Yordar will send you an order confirmation by email with a 6-digit order reference number. An email from Yordar confirming acceptance of your order represents confirmation of your order, unless the email states that it is a quote. If no email confirmation is received, the order is NOT accepted.

The order will be delivered and prepared as per the details in this order confirmation email. Please note that your order will arrive within a window of your requested delivery time. It is the customer's responsibility to review the details of your order and notify Yordar of any omissions or corrections. The order confirmation is not an invoice for your order. Please refer to the invoicing item below for more information on the process.

Calendar reminder

Yordar will attach a calendar reminder with each order confirmation email. This is a useful scheduling tool.

Changes to your order

You are welcome to make changes to your order. However, changes made after supplier cut-offs and before delivery may not be accepted.

Yordar will do its best to facilitate changes made with short notice, however, charges may be incurred. In the event a supplier cannot fulfil your order or part of your order, with your permission or notification, Yordar will transfer the order to another supplier, or substitute unavailable menu items. Once notified or approved, the customer will be liable for full payment of the adjusted or transferred order. When a change is requested on your order, Yordar will resend you your order confirmation reflecting the change and indicating the order is updated.

Order cancellation

All cancellations are required in writing or submitted through Yordar’s online platform.

For orders less than $500, Yordar will accept cancellation up to 24 hours prior to the delivery date requested for that order.

Orders greater than $500 require a minimum 48 hours' notice, leeway may be given if the vendor agrees. Orders under our Functions and Events department require a minimum of 3 working days’ notice for cancellations to be accepted.

Melbourne Cup orders require a minimum 7 working days’ notice for cancellations to be accepted.

Orders cancelled after the above times may incur charges based on expenses incurred by Yordar or the supplier. Yordar will do its best to minimise these charges for you.

Changes and cancellation of standing orders

Changes or cancellations to your standing orders must be made before 12pm the business day prior to delivery, and more time may be required for orders outside of capital city CBDs. All cancellations are required in writing or submitted through Yordar’s online platform.

Food allergies

Please be advised that Yordar’s suppliers will do their best to ensure your catering does not contain any of the items to which your guest is allergic.

Please be advised however that Yordar’s suppliers cannot guarantee your order may not contain traces of the substances to which your guest is allergic.

Yordar and its suppliers will not take responsibility for any illness caused by the consumption of catering containing traces of these substances or food groups. We recommend that severely allergic guests supply their own food from a reliable source that can guarantee no cross-contamination.

Platter and equipment collection

In the event the customer has an order for a function, the supplier will collect their equipment within 48 hours after the function. Please ensure they are cleaned and placed in a convenient location for the supplier to retrieve their equipment. Lost or broken equipment will be charged to the customer at their replacement value.

Pricing information

Please note all menu prices exclude GST. The 10% Goods & Services Tax is added to those items that incur GST at the time of purchase. Yordar will strive to maintain our prices, however, we reserve the right to alter prices without notice. Yordar can only guarantee pricing on accepted orders for a maximum of 4 weeks.

Invoicing

Yordar will issue an invoice after the order has been delivered. The invoice will reflect the items and prices outlined within the confirmation email. Invoices are issued by email based on the agreed payment type and invoicing frequency terms. Please refer to the payment items below for more information.

Adjustments to your order post-delivery

In the event an order is missing any items, please notify Yordar within 24 hours of the delivery and we will adjust your invoice. We cannot guarantee an invoice will be adjusted if we are notified of an omission more than 72 hours after delivery.

Payment options

Customer payments shall be effected by way of cheque, electronic funds transfer (EFT), or our secure online credit card merchant facility. The customer's business account will be credited from the date a payment is received by Yordar, other than in the instance when a cheque is used as the method of payment. Where the customer pays by cheque, the customer's business account will be credited by the amount of a cheque payment when the cheque is cleared.

Note: A deposit may be required on certain orders. Invoices are sent to your email address unless otherwise requested.

Credit card payment

Yordar accepts all major credit cards. Credit card payments will incur a fee. Domestic cards incur a 1.7% + 30c merchant fee. International cards incur a 3.5% + 30c merchant fee.

Payment terms

The customer undertakes to pay to Yordar all amounts in the statement of account within 7 days of the date of issue of the Statement of Account unless other terms have been agreed to.

Statements are emailed to your chosen billing address during the first week of each month. Payments by credit card are applied the day after delivery, however, we will apply a credit card preauthorization to hold funds up to the value of the order.

Late payments

If it is determined that the due amount stands after 30 days from invoice date and payment is further delayed, Yordar may within its rights apply a late payment fee for every calendar month the invoice remains outstanding being either $15 per calendar month, or 15% of the invoice total, whichever is the greater amount, until the invoice is finalised

Limitation of liability and disclaimer

To the extent permitted by law, Yordar will have no responsibility or liability for:

Any refusal by a supplier or any other person to supply the product the customer seeks to purchase using the customer's business account, regardless of the reason for that refusal

Products purchased by the customer from the supplier will be at the customer's risk upon delivery to the customer, or such place as specified by the customer or into the customer's custody (whichever occurs first).
